It is not uncommon for a foreign diplomat’s driver to be pulled over on the street and subjected to a search. The difference is that the driver of a domestic diplomat is treated differently. The driver of a foreign diplomat is usually never asked for his license or registration; he is never detained and questioned; and if he is ever detained and searched, it is done only when a criminal investigation is being conducted.
For a long time, it was an open secret that foreign diplomats were not being treated like US citizens. It is a well-known fact that diplomats are not subject to the same laws that we citizens are. But, I found out from a legal expert that the reason the law is not applying in a uniform fashion is because foreign diplomats are protected by the Diplomatic Relations Act of 1978, which overrides the Fourth Amendment and the Equal Protection Clause of the Fourteenth Amendment.
I read the Diplomatic Relations Act and then I went to the US Court of Appeals for the District of Columbia Circuit to argue that this statute was unconstitutional.
The judges at the court agreed that the law was unconstitutional. After the decision, I received a call from the Secretary of State asking me to rescind the decision. I said no.
I thought I was finished and decided to put the whole matter behind me. But then the US Attorney’s Office for the District of Columbia and the Department of State contacted me and began making threats. I became fearful. They threatened that if I did not withdraw the case, the US Government would bring charges against me for my refusal to obey the government. I was concerned for my safety and I decided to recuse myself from the case.
